Agreement
By opting in to receive SMS/MMS messages from Renew Vein and Vascular Inc. ("we," "us," "our") via our toll-free or A2P 10DLC numbers, you agree to these Terms and Conditions ("Terms") and our Privacy Policy at https://contact.renewwound.com/privacy-policy. These Terms comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles, HIPAA, and carrier requirements for A2P messaging.

Services
We provide SMS/MMS notifications for healthcare purposes, such as appointment reminders, wound care updates, or post-treatment follow-ups (approximately 1-4 messages per month). Messages are solely for treatment-related communication and not for marketing unless you provide separate consent. Message and data rates may apply; consult your mobile carrier for details.

Eligibility and Consent
To participate, you must be:

18 years or older.

A resident of the United States or Canada.

A patient or authorized representative of Renew Vein and Vascular Inc.
You must provide explicit, written consent to receive SMS (e.g., via an unchecked checkbox: “I consent to receive SMS notifications from Renew Vein and Vascular Inc. Msg & data rates may apply. Reply STOP to cancel.”). We retain consent records as required by law. You may revoke consent at any time (see Opt-Out below).

Opt-In and Opt-Out

Opt-In: Consent is collected via web forms, paper forms, or verbal agreement during patient intake, with a link to these Terms and our Privacy Policy.

Opt-Out: To stop receiving messages, reply “STOP” to any SMS; we will send a one-time confirmation and cease further messages. To resume, you must opt in again.

Your Responsibilities
You agree to:

Provide an accurate, active mobile number.

Notify us of any changes to your contact information.

Use our SMS services lawfully and not for illegal purposes.
We may monitor messages for compliance with these Terms and applicable laws.

Data Handling
We limit the use of protected health information (PHI) in SMS to the minimum necessary per HIPAA. Your data is not sold or shared with third parties for marketing. Data may be shared with service providers (e.g., GHL) under HIPAA-compliant Business Associate Agreements (BAAs) or as required by law. See our Privacy Policy for details.

Disclaimers and Liability

Services are provided “as is” without warranties of any kind.

We are not liable for delays, failures, or issues caused by mobile carriers or third parties.

You indemnify us against claims arising from your misuse of our SMS services.

We reserve the right to suspend or terminate services for non-compliance with these Terms.

Governing Law and Dispute Resolution
These Terms are governed by California law. Any disputes will be resolved through binding arbitration in Los Angeles, CA, per the American Arbitration Association’s rules, except where prohibited by law.

Changes to Terms
We may update these Terms at any time. Changes will be posted at https://contact.renewwound.com/termsandcondtions, and continued use of our SMS services constitutes acceptance.
